Please read these terms carefully before using the OnGoCart platform.

These Terms of Service ("Terms") govern your access to and use of the OnGoCart mobile application and website at ongocart.com (together, the "Platform"), operated by OnGoCart ("we," "us," "our"), registered at G1, Aanchal Apartment, Sahakar Marg, Lalkothi, Jaipur, Rajasthan 302005, India. By downloading, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1What OnGoCart Is
OnGoCart is a discovery platform that connects independent street cart vendors ("Vendors") with nearby customers ("Customers") through a live, location-based map. Vendors create time-bound listings showing their location, category, and available items; Customers browse these listings to find and visit Vendors in person.
OnGoCart is not a marketplace, delivery service, or payment intermediary for the sale of goods between Vendors and Customers. All purchases happen directly and independently between Customer and Vendor, in person, outside the Platform. OnGoCart is not a party to, and does not process payment for, any such transaction, and takes no commission on Vendor sales.
2Eligibility
Customers may use the discovery features of the Platform without creating an account, regardless of age, though we recommend the Platform be used by, or under the supervision of, individuals aged 18 or older where any account features are used.
Vendors must be at least 18 years old and legally capable of entering into a binding contract under the Indian Contract Act, 1872, to register, subscribe, and create listings.
By registering as a Vendor, you confirm that all information you provide is accurate, current, and that you have the legal right to sell the goods you list.
3Account Registration (Vendors)
- Vendors must provide accurate registration information, including a valid mobile number, and keep this information up to date.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- OnGoCart reserves the right to suspend or terminate any account found to contain false, misleading, or fraudulent information.
4Vendor Subscription and Payments
Creating and maintaining an active thela listing requires an active paid subscription, the terms of which (pricing and billing cycle) are presented in-app at the time of purchase and are incorporated into these Terms by reference.
The subscription is billed on an annual (yearly) basis. At the time of purchase (and at each renewal), the Vendor chooses between two renewal modes:
Auto-Renewal
The subscription automatically renews at the end of the current term, at the then-current subscription price, using the payment method on file, unless the Vendor turns off Auto-Renewal before the renewal date.
Manual Renewal
The subscription simply expires at the end of the current term, and the Vendor must actively purchase a new subscription to reactivate their listing.
Once a subscription term is purchased, that term is final: it cannot be cancelled, paused, prorated, or refunded, in whole or in part, for any reason, including if the Vendor stops using the Platform partway through the term. The Vendor's paid access continues for the full term regardless.
Cancelling Auto-Renewal only stops the next renewal charge — it does not cancel or refund the current, already-active subscription term. A Vendor who has turned off Auto-Renewal will retain listing access until the end of their current paid term, after which the subscription will expire unless manually renewed.
Payments are processed through our third-party payment gateway. OnGoCart does not store your full payment card or UPI credentials.
Failure to maintain an active, paid-up subscription (whether by choosing not to renew manually, or by turning off Auto-Renewal) will result in the deactivation of the Vendor's listing(s) until the subscription is renewed or a new subscription is purchased.
4.1 Auto-Renewal Disclosure and Management
- Vendors who select Auto-Renewal will be shown the renewal amount and billing cycle at the time of subscribing, and must provide explicit consent before the first payment is processed.
- OnGoCart will send a reminder notification before each Auto-Renewal charge, in line with applicable RBI guidelines on recurring payments.
- Vendors can turn Auto-Renewal on or off at any time. Turning off Auto-Renewal takes effect for the next renewal cycle only and does not affect the current term already paid for.
5Vendor Listing Rules and Responsibilities
By creating a listing, Vendors agree to:
- Provide accurate information about their category, items available, location, and operating hours. Listings must reflect what is genuinely being offered at that time and place.
- Deactivate a listing before creating a new one for a different location or day, as required by the Platform's design.
- Update or close a listing promptly once the vendor is no longer at the stated location or no longer has the stated items available.
- Not use the Platform to list or sell any goods that are illegal, counterfeit, unsafe, or in violation of applicable food safety, licensing, or municipal vending regulations.
- Comply with all applicable local, state, and national laws governing street vending, including any vending license or permit requirements under the Street Vendors Act, 2014, and related state rules.
OnGoCart does not verify the accuracy of Vendor-provided information (e.g., freshness, pricing, quality of goods) and is not responsible for the accuracy of any listing beyond what the Vendor has entered. Customers should use their own judgment when visiting and purchasing from any Vendor.
6Customer Use of the Platform
Customers agree to use the Platform only for its intended purpose — discovering nearby Vendor listings — and not to:
- Misuse location features to harass, stalk, or track any Vendor or other individual.
- Submit false reports, reviews, or complaints about a Vendor with the intent to harm their listing or reputation.
- Attempt to interfere with, disrupt, or reverse-engineer the Platform.
7Stock Clearance Feature
The "Stock Clearance" feature allows a Vendor to voluntarily flag discounted items in the evening. Participation is entirely optional and controlled by the Vendor. OnGoCart does not set, verify, or guarantee any discount amount, item quality, or availability under this feature.
8Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Upload or transmit any content that is defamatory, obscene, harmful, or infringes on the rights of others.
- Attempt to gain unauthorized access to the Platform, other users' accounts, or our systems.
9Intellectual Property
The Platform, including its design, logo, "OnGoCart" name and branding, software, and content (excluding Vendor-submitted listing content), is owned by OnGoCart and protected under applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Platform without our prior written consent.
Vendors retain ownership of the content they submit (e.g., listing descriptions) but grant OnGoCart a non-exclusive, royalty-free license to display that content on the Platform for the purpose of operating the Service.
10Disclaimers
The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to accuracy, completeness, reliability, or fitness for a particular purpose.
OnGoCart does not guarantee that any Vendor listing is accurate, current, or available at the time a Customer visits, since Vendor circumstances (stock, location, timing) can change quickly and are entirely Vendor-controlled.
OnGoCart is not responsible for the quality, safety, legality, or fitness of any goods sold by a Vendor, or for any transaction, dispute, or interaction between a Customer and a Vendor.
11. Limitation of Liability
To the maximum extent permitted under applicable Indian law, OnGoCart, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Platform, any transaction between a Customer and a Vendor, or any listing inaccuracy. OnGoCart's total liability for any claim arising from these Terms shall not exceed the amount, if any, paid by you to OnGoCart.
12. Indemnification
You agree to indemnify and hold harmless OnGoCart and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any applicable law or third-party right.
13. Suspension and Termination
OnGoCart may suspend or terminate any account, listing, or access to the Platform at its discretion, with or without notice, if we reasonably believe these Terms have been violated, or if required by law. Vendors may deactivate their account and cancel their subscription at any time.
14. Changes to These Terms
We may revise these Terms from time to time. Material changes will be communicated through the app or website, along with an updated "Last Updated" date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan.
16. Refund & Expiry Policy
Coupons and active Vendor subscriptions are subject to a strict no-refund policy. Please review the terms carefully before making a purchase:
- Coupon Purchases: All subscription coupon purchases are final. Once a coupon is purchased from our platform, it cannot be returned, exchanged, or refunded under any circumstances.
- Active Subscriptions: Once a coupon is redeemed and a subscription is activated on an account, it is strictly non-refundable. We do not offer prorated refunds, cancellations, or credits for any partially used subscription periods.
- Expiration of Coupons: Each purchased coupon is valid for a period of 90 days from the date of purchase. If a coupon is not redeemed within this 90-day window, it will automatically expire and become invalid.
By proceeding with a purchase or activating a subscription, you acknowledge and agree to this no-refund and expiry policy.
